Terms of Service

These Terms of Service ("Terms") govern your access to and use of the Stonk Daily mobile application (the "App") and the website at stonkdaily.ai (the "Site," and together with the App, the "Service") provided by Stonk Daily LLC ("Stonk Daily," "we," "us," or "our").
By creating an account or using the Service, you agree to these Terms. If you do not agree, do not use the Service.
1. Eligibility
You must be at least 13 years old to use the Service. If you are between 13 and the age of majority in your jurisdiction, you may use the Service only with the consent and supervision of a parent or legal guardian who agrees to these Terms on your behalf.
You may not use the Service if you are barred from doing so under applicable law or if your access has been previously suspended or terminated by us.
2. Account
To use the Service, you must sign in with Apple. You are responsible for maintaining the confidentiality of your account and for all activities that occur under it. You agree to notify us promptly at hello@stonkdaily.ai of any unauthorized access to or use of your account.
3. Subscription Terms
The Service offers an auto-renewing subscription called Stonk Daily Pro, available in two terms:
- Monthly: $6.99 per month
- Annual: $49.99 per year
Prices may vary by region as displayed in the App. New users may be eligible for a 7-day free trial.
Auto-Renewal
Your subscription automatically renews at the end of each billing period unless you cancel at least 24 hours before the renewal date. Your Apple ID will be charged the renewal price within 24 hours of the renewal date. You can manage and cancel your subscription at any time through your Apple ID settings: Settings → [Your Name] → Subscriptions.
Free Trial
If you start a 7-day free trial, you will not be charged during the trial period. If you do not cancel before the trial ends, your subscription will automatically convert to a paid subscription at the price disclosed in the App. You are eligible for the free trial only once per Apple ID per subscription group.
Refunds
All purchases are processed by Apple and are subject to Apple's refund policies. To request a refund, visit reportaproblem.apple.com. We do not process refunds directly.
Price Changes
We may change subscription prices from time to time. If we change the price of your subscription, we will notify you in advance and obtain your consent where required by Apple's policies.
4. The Service Is Not Financial Advice
Stonk Daily provides general information about publicly traded securities. The Service does not provide investment advice, financial advice, tax advice, legal advice, or any other professional advice.
The briefings, summaries, market data, and any other content provided through the Service are for informational and educational purposes only. They are not recommendations to buy, sell, or hold any security and should not be relied upon as the basis for any investment decision.
You are solely responsible for your investment decisions. Past performance does not predict future results. Investing in securities involves risk, including the possible loss of principal. You should consult a qualified financial advisor before making investment decisions.
The Service is not a broker-dealer, registered investment adviser, or any other regulated financial entity. We do not execute trades, manage portfolios, or hold any client funds.
5. AI-Generated Content
Briefings and other content provided through the Service are generated in part by artificial intelligence, including large language models operated by third parties. AI-generated content may contain errors, omissions, or inaccuracies. We make no warranty as to the accuracy, completeness, or timeliness of any AI-generated content.
You should independently verify any information provided by the Service before relying on it.
6. Acceptable Use
You agree not to:
- Use the Service for any unlawful purpose or in violation of these Terms
- Attempt to gain unauthorized access to the Service, our systems, or other users' accounts
- Reverse engineer, decompile, or attempt to extract the source code of the App
- Scrape, harvest, or otherwise collect data from the Service through automated means
- Resell, redistribute, or commercially exploit content from the Service
- Interfere with or disrupt the Service, including by transmitting malware or excessive request volumes
- Misrepresent your identity or affiliation with any person or entity
We may suspend or terminate your account for any violation of these Terms.
7. Intellectual Property
The Service, including all content, code, design, branding, and trademarks, is owned by Stonk Daily LLC or its licensors and is protected by copyright, trademark, and other intellectual property laws.
We grant you a limited, non-exclusive, non-transferable, revocable license to use the App for your personal, non-commercial use, subject to these Terms.
You retain any rights you have in the watchlist data you provide. By using the Service, you grant us a non-exclusive, royalty-free license to process your watchlist data as needed to provide the Service.
Market data, news content, and stock logos displayed in the Service are provided by third parties and are subject to their respective rights.
8. Third-Party Services
The Service relies on third-party services to operate. We are not responsible for the availability, content, or practices of these third parties. Your use of features that depend on these third parties is subject to their respective terms.
The App may display links to third-party websites. We are not responsible for the content of those websites.
9. Disclaimers
THE SERVICE IS PROVIDED "AS IS" AND "AS AVAILABLE" WITHOUT WARRANTIES OF ANY KIND, EXPRESS OR IMPLIED, INCLUDING WARRANTIES OF MERCHANTABILITY, FITNESS FOR A PARTICULAR PURPOSE, NON-INFRINGEMENT, ACCURACY, OR UNINTERRUPTED OR ERROR-FREE OPERATION.
WE DO NOT WARRANT THAT THE SERVICE WILL MEET YOUR REQUIREMENTS, THAT BRIEFINGS WILL BE ACCURATE OR TIMELY, OR THAT MARKET DATA OR NEWS CONTENT WILL BE FREE OF ERRORS.
WE DO NOT WARRANT THE PERFORMANCE OF ANY SECURITY DISCUSSED IN THE SERVICE.
10. Limitation of Liability
TO THE FULLEST EXTENT PERMITTED BY LAW, STONK DAILY LLC AND ITS OFFICERS, DIRECTORS, EMPLOYEES, AND AGENTS WILL NOT BE LIABLE FOR ANY INDIRECT, INCIDENTAL, CONSEQUENTIAL, SPECIAL, EXEMPLARY, OR PUNITIVE DAMAGES, INCLUDING LOST PROFITS, LOST DATA, OR INVESTMENT LOSSES, ARISING OUT OF OR RELATED TO YOUR USE OF THE SERVICE, REGARDLESS OF THE THEORY OF LIABILITY.
OUR TOTAL LIABILITY FOR ALL CLAIMS RELATED TO THE SERVICE WILL NOT EXCEED THE GREATER OF (A) THE AMOUNT YOU PAID US IN THE 12 MONTHS BEFORE THE CLAIM AROSE OR (B) $100.
Some jurisdictions do not allow the exclusion of certain warranties or limitations of liability, so some of the above may not apply to you.
11. Indemnification
You agree to indemnify and hold harmless Stonk Daily LLC and its officers, directors, employees, and agents from any claims, damages, losses, liabilities, and expenses (including reasonable attorneys' fees) arising out of or related to your use of the Service, your violation of these Terms, or your violation of any third-party rights.
12. Termination
You may terminate your use of the Service at any time by deleting your account through the App.
We may suspend or terminate your account at any time, with or without notice, for violation of these Terms or for any other reason at our sole discretion. Upon termination, the rights granted to you under these Terms will end, but Sections 4, 5, 7, 9, 10, 11, 13, and 14 will survive.
13. Governing Law and Dispute Resolution
These Terms are governed by the laws of the State of New Mexico, without regard to conflict of laws principles.
Any dispute arising out of or related to these Terms or the Service will be resolved in the state or federal courts located in New Mexico, and you consent to the personal jurisdiction of those courts.
You agree that any claim must be brought within one year after the cause of action arose, or it will be permanently barred.
14. Changes to These Terms
We may update these Terms from time to time. If we make material changes, we will update the "Last updated" date and, where appropriate, notify you through the App. Your continued use of the Service after changes are posted constitutes your acceptance of the updated Terms.
15. Apple App Store Terms
You acknowledge that these Terms are between you and Stonk Daily LLC, not Apple. Apple is not responsible for the App or its content. In the event of a conflict between these Terms and Apple's terms, Apple's terms will govern with respect to your use of the App through the App Store. Apple is a third-party beneficiary of these Terms with the right to enforce them against you.
16. Miscellaneous
If any provision of these Terms is held unenforceable, the remaining provisions will continue in full force. Our failure to enforce any provision is not a waiver of that provision. These Terms constitute the entire agreement between you and Stonk Daily LLC regarding the Service.
